Wardens observed surfaces with rust and chewed/scratched unsealed wood housing dogs.

This warden observed metal strand flooring in primary enclosures that no longer has a vinyl type coating on it.

Warden viewed that the kennel owner surpassed the Kennel Class II non-commercial kennel type by transferring ownership of more than 60 dogs throughout the 2021 calendar year. The definition of “commercial kennel” in Section 102, together with the establishment of different categories of commercial licenses in Section 206(a), establish that a kennel must have one of the enumerated commercial licenses in order to transfer more than 60 dogs a year. By inference, a “Kennel Class II” may transfer up to 60 dogs a year but no more. This Warden directs that the kennel owner take the following action(s): Any person who keeps or operates a kennel shall, on or before January 1 of each year, apply to the department for a kennel license. Kennels shall be classified by type, and the fee for the license shall be determined by the kennel type, the number of dogs housed, kept, harbored, boarded, sheltered, sold, given away or transferred in or by the kennel. The application forms and kennel licenses shall be as designated by the secretary. A separate license shall be required for each type of kennel and every location at which a kennel is kept or operated. A kennel license is required to keep or operate any kennel. All kennel licenses shall expire on December 31. When two or more licensed kennels are operated by the same person at the same location, each kennel shall be inspected and licensed as required by law.

By inference, a “Kennel Class II” may transfer up to 60 dogs a year but no more. E & Z Puppies violated the Dog Law when it transferred on dog in excess of the 60-dog transfer limit in 2021 for a Kennel Class II. Specifically, it did not have “the appropriate license” when it transferred the 61st dog on November 29, 2021. This Warden directs that the kennel owner take the following action(s): It shall be no defense to any civil penalty or criminal prosecution under this act that a person operating a kennel failed to properly obtain the appropriate license.

There were no smoke alarms or fire extinguishers present in the kennel facility.

The written program of veterinary care was not established at the time of this inspection.

This Warden viewed a few adult dogs that did not have the minimum amount of floor space in their primary enclosures as required by this section.

This Warden viewed adult dogs that did not have the minimum amount of exercise area as required by this section.

This Warden viewed adult dogs that did not have an exercise area on ground level as required.

The kennel owner failed to have all dogs examined by a veterinarian at least once every six months.

A written certification under the signature and seal of a professional engineer was not present.

Without a written certification from an engineer, this warden was unable to make the minimum inspection of assuring that the proper mechanical ventilation, auxiliary ventilation, or humidity control system was installed or operational.

Without a written certification from an engineer, it was unknown to this warden if a proper mechanical ventilation system was installed to meet the standards required by this chapter.
