After a thorough review of the kennel records, this Warden found records showing the kennel selling 7 puppies under eight (8) weeks of age.

Warden viewed that the kennel owner surpassed the Kennel Class II ‘non-commercial’ kennel type by transferring ownership of four (4) puppies to a pet shop kennel on January 31, 2022. An inspection of Jodis Bow Wow Shoppe, LLC. a licensed pet shop kennel number #17775 on March 28, 2022, reflected this transaction on a bill of sale for the pet shop. The bill of sale was dated January 31, 2022 for the four (4) puppies. The definition of “commercial kennel” in Section 102, together with the establishment of different categories of commercial licenses in Section 206(a), establish that a kennel must have one of the enumerated commercial licenses in order to transfer any dogs to a dealer or pet shop kennel. By inference, a “Kennel Class II” may only transfer ownership of dogs via retail sales only and not to a dealer or pet shop kennel.

There was no upgrade kennel application submitted to the Department within 7 days of that date. The definition of “commercial kennel” in Section 102, together with the establishment of different categories of commercial licenses in Section 206(a), establish that a kennel must have one of the enumerated commercial licenses in order to breed and whelp dogs and transfer any dog to a dealer or pet shop kennel. By inference, a “Kennel Class II” may transfer dogs to individuals retail but not to dealers or pet stores. Whispering Brook Kennel violated the Dog Law when it transferred ownership of four (4) Australian Shepherd puppies to a pet shop kennel on January 31, 2022. Specifically, it did not have “the appropriate license” when it transferred the four puppies to the pet store known as Jodi’s Bow Wow Shoppe, LLC / Vinnie’s Bow Wow Shoppe.

The kennel owner did not have the litter of four (4) Australian Shepherd puppies sold to Jodis Bow Wow Shoppe, LLC, a licensed pet shop kennel on their kennel records.
