• Applied for Class III not C

  The kennel operator failed to obtain the appropriate type and class of kennel license. In 2025, this Kennel Class III license holder that breeds and whelps dogs, transferred ownership of 63 dogs, exceeding its transfer threshold by three (3) dogs in 2025. The kennel subsequently applied for the same Kennel Class III license in 2026, although section 206(a)(1) requires the license to be determined by the number transferred in or by the kennel during the previous year, thus the appropriate license type would be a Kennel Class C license.

The actions of the kennel to breed and whelp dogs while also transferring ownership of more than 60 dogs in the same calendar year, meet the exact definition of a commercial kennel as defined in section 102 of the Dog Law. The kennel operator failed to apply for and license as the appropriate Kennel Class C license type.

• Operating as unlicensed Class C kennel

  The kennel licensed as a Kennel Class III failed to obtain the appropriate Kennel Class C license in 2025 and 2026. The kennel has been operating as an unlicensed Commercial Kennel C Kennel type as defined in section 102 of the Dog Law.
