- Commercial kennel license not obtained
The kennel owner failed to obtain the appropriate type and class of kennel license. This K Kennel Class II kennel license holder, who bred and whelped dogs, transferred ownership of five (5) dogs to a dealer kennel in 2026. A Kennel Class II is not allowed to transfer any dogs for resale. The definition of “commercial kennel” in Section 102, together with the establishment of different categories of commercial licenses in Section 206(a), establish that a kennel must have one of the enumerated commercial licenses in order to transfer any dogs to a dealer kennel. By inference, a “Kennel Class II” may transfer ownership of dogs via retail sales only and not to a dealer kennel. Thus, the appropriate license type would be a Commercial Kennel Class C license.
